Dear Secretary Sebelius, 

Since October 1, 2013, more than 5 million Americans have accessed high-quality affordable 
insurance, many for the first time or after years of being denied insurance due to a pre-existing 
condition. Thank you for everything you and your staff have done to ensure this success. The 
magnitude of this new era of health coverage cannot be overstated, and our organizations have 
been and continue to be proud supporters of the Affordable Care Act.
 
The online application process has improved significantly since October, allowing the majority 
of consumers to successfully apply for and acquire health insurance. However, the upcoming end 
of open enrollment poses a significant concern for consumers who continue to encounter 
problems completing the application and enrollment process. 

We strongly believe that consumers who begin a Federally Facilitated Marketplace application 
prior to March 31 but are unable to complete it by the close of open enrollment due to 
technology obstacles or administrative challenges beyond their control, such as awaiting an 
outstanding appeal or a Medicaid determination, should have the opportunity to complete 
enrollment after March 31. 

 Throughout open enrollment, CMS has allowed flexibility on effective dates for coverage such 
as modifying the December 15 deadline and the February 15 deadline. Continuing this flexibility 
to ensure that consumers who begin the application prior to March 31 have the opportunity to 
complete enrollment is a reasonable and fair request. 

The organizations listed below respectfully ask that you support the individuals who have 
made a good faith effort to sign up for coverage and started the application process but 
cannot complete it by March 31. The Administration could make a powerful and 
meaningful decision to help consumers who acted responsibly to meet the open enrollment 
deadline by allowing their applications to be completed once the underlying technology and 
administrative issues are resolved. This action would also be an important way to ensure 
the mission of the Affordable Care Act is fulfilled.
